Ora-Visio is a website accessible at the following address ora-visio.com<\/a> (the “Site”), operated by ORA, a French limited liability company (SARL) with capital of 5,000 euros, whose registered office is located at 82, vielle route de la Gavotte, Les Pennes-Mirabeau (13170), France, registered with the Aix-en-Provence Trade and Companies Register under number 515 375 400, and whose intra-Community VAT number is FR47515375400 (the “Site”).<\/p>\n

On the Site, professionals within the meaning of consumer law (the “Provider”) offer their services in fields including in particular speech therapy, psychology or academic support, to which any user of the Site meeting the eligibility conditions of article 1.1 below (the “Client”) may subscribe.<\/p>\n

The Provider carries out their services within the framework of online consultations (the “Appointment(s)”), the purpose of which is defined by the Provider on the Site.<\/p>\n

These General Terms of Service apply, without restriction or reservation and to the exclusion of all other terms, to the Provider’s Appointments. They are intended to govern the contractual relationship between the Provider and the Client, it being specified that the Platform remains a third party to these General Terms and their consequences.<\/p>\n

The Client acknowledges having the capacity required to enter into a contract and book Appointments. They declare that they have read these General Terms of Service and have accepted them by ticking the box provided for this purpose before proceeding with the online booking process.<\/p>\n

Article 1 – Appointments<\/h2>\n

1.1. Eligibility for the online Appointment booking service<\/strong><\/h3>\n

The Appointment booking service on the Site is reserved exclusively for natural persons who have reached the age of 18 and have full legal capacity.<\/p>\n

1.2. Characteristics of Appointments<\/strong><\/h3>\n

The main characteristics of Appointments, which the Client must review before any booking, are presented on the Site. Any request by the Client for additional services not included will be invoiced by the Provider and collected via the Site.<\/p>\n

Any photographs, videos and graphics presented on the Site, in particular illustrating Appointments, are not contractual and cannot make the Provider liable.<\/p>\n

Appointments may only be booked within the limits of the Provider’s availability as indicated on the Site.<\/p>\n

Appointments are carried out exclusively online on the platform accessible at the following address: ora-visio.com<\/a> (the “Platform”).<\/p>\n

The Client must equip themselves, at their own expense, with a compatible tablet and\/or computer, a headset with microphone, a webcam and a secure broadband internet connection sufficient for audio\/video streaming in order to access the Platform.<\/p>\n

The Client must also download and install software or an application in accordance with the instructions given on the Site, including, among others, the Zoom software downloadable at the following address: https:\/\/zoom.us. The Partner cannot be held liable for the manner in which the Client installs and uses the software.<\/p>\n

In the event the Platform is unavailable, the Client already agrees to make use of the alternative solutions offered by the Provider.<\/p>\n

The Client may not require the Provider to make any particular and\/or specific preparation in relation to their needs ahead of the Appointment. Accordingly, any elements that may be communicated by the Client prior to the Appointment via the Site will not necessarily be subject to an in-depth review and\/or analysis by the Provider.<\/p>\n

1.3. Booking arrangements<\/strong><\/h3>\n

A Client wishing to book an Appointment must provide, in particular, their first and last name, email address, phone number and postal address. They must first choose a date, location and time slot that suits them from those shown as available on the Site.<\/p>\n

The Client is strongly advised to confirm their availability for the chosen time slot and date with the Provider. Should the Provider exceptionally not be available on the dates or time slots chosen by the Client, notwithstanding any indication to the contrary on the Site, the Client shall have the option to (i) agree on another date with the Provider, or (ii) request a refund of the amounts paid for booking the relevant Appointment. The Client must notify their choice within 30 calendar days of the Provider’s notification of their unavailability via the internal messaging service on the Site. After this period, the Client may no longer claim a refund of their booking or a change of date or time slot. In any event, the Client may not claim compensation for any direct or indirect damage related to the Provider’s unavailability.<\/p>\n

The booking will only be considered final once confirmation of the corresponding payment has been sent to the Client by email. The Client shall take care to keep said confirmation.<\/p>\n

ARTICLE 2 – PRICE<\/h2>\n

The price of Appointments is shown on the Site. Prices are expressed in euros, inclusive of all taxes.<\/p>\n

Prices take into account any discounts that may be granted. They are fixed and non-revisable during their period of validity as indicated on the Site.<\/p>\n

Given the specific nature of the Client’s request, an additional cost may be charged to them. The Provider will then agree with the Client on the terms of payment for this additional cost, which shall necessarily be made on the Site.<\/p>\n

An invoice is drawn up by the Provider and given to the Client when booking the Appointment.<\/p>\n

ARTICLE 3 – PAYMENT TERMS<\/h2>\n

The price is payable in full on the Site, by secure payment, according to the following terms:<\/p>\n

By bank card: Carte Bleue (CB), Visa, MasterCard.<\/p>\n

Payments made by the Client will only be considered final once the amounts due have been effectively collected by the Provider.<\/p>\n

Without prejudice to any damages, the Client’s failure to pay any amount when due shall automatically result in:<\/p>\n
